Editorial Reviews

Doody's Review Service
Reviewer: Tony A. Fletcher, PsyD (Rush University Medical Center)
Description: This is the third edition of a well-rounded, classic text on the impact of regulations and the law on the daily functioning of psychiatric and psychological practice. This single resource is a comprehensive guide, which has been devised to be a ready-to-use reference on how to deal with pertinent issues related to protecting the patient as well as the clinician from legal recourse.
Purpose: The purpose is to provide the clinician with a usable guide when queries arise regarding the influence of legal issues as related to clinical practice. The authors' intention is to interrelate legal and clinical aspects of a particular issue and to convey the history of the law's approach to a problem as it relates to the current status of the law. This is an important addition to any healthcare facilities library, and is an contribution to the understanding of the complexity of the law and ways of effectively dealing with legal issues as they pertain to clinical practice.
Audience: This book is well suited for all levels of mental health professionals who are interested in a clinical practice. The authors of this text are well known in the field of psychiatry and the law, and prior editions of this book have received many awards and recognitions.
Features: In order to facilitate a basic overview of pertinent legal issues related to practice, the authors give case examples followed by relevant legal and clinical issues, potential problems, guides for action, and suggested readings for each chapter.
Assessment: This is an excellent text, and the authors use a superb format to implement the understanding of particular details of the law and regulations that govern the practice of psychology and psychiatry. This should be required reading for any clinician in practice. In this third edition, the authors address more current issues including liability in managed care, third party access to records, recovered memory, ERISA, and advance directives.

Managed care, new research on patients' capacities to grant informed consent, and advance directives for psychiatric care are among the prompts for this update of the award-winning 1991 manual on the impact of the law on the practice of psychiatric/ psychological care. Chapters feature case examples framing the legal and clinical issues, pitfalls, and action guides. The final chapter provides guidelines for clinicians testifying in the "foreign country" of court and writing forensic reports. The authors are Boston-area psychiatrists: Gutheil at Harvard Medical School, and Appelbaum with the U. of Massachusetts Medical School. Annotation c. Book News, Inc., Portland, OR (booknews.com)
