Overview

The conflict of laws comprises part of any country's private law which regulates certain types of problem that arise when a dispute has some connection with another country. It is concerned with such issues as the court's jurisdiction to determine such a dispute, the choice of the country whose law will be applied in determining the merits of the dispute, and the recognition or enforcement of a foreign judgment. This book provides a comprehensive and up-to-date analysis of the current English rules on the conflict of laws, providing detailed treatment of the increasing impact of the European Community in this sphere of the law. Particular emphasis is placed on the analysis of international conventions concluded within the framework of the European Community. These include the Brussels and Lugarno Conventions on civil jurisdiction and judgments, and the relevant international conventions negotiated by the Hague Conference on Private International Law, such as the Convention on child abduction. The Conflict of Laws provides the information and critical analysis required by students taking the subject at undergraduate level, or as part of their professional examinations, as well as being relevant to those studying related areas of the law, such as International Law and European Community Law. It will also prove an invaluable source for practising lawyers in private practice or in the governmental or corporate sector.
