Studienarbeit aus dem Jahr 2006 im Fachbereich Jura - Rechtsphilosophie, -soziologie, -geschichte, Note: 13 Punkte, Johann Wolfgang Goethe-Universität Frankfurt am Main, Sprache: Deutsch, Anmerkungen: Breiter Korrekturrand , Abstract: In seinen Aufsätzen „Die Ungerechtigkeit der Gerechtigkeit", bzw. „Rechtfertigung der Gerechtigkeit" kritisiert Rainer Forst zunächst anhand zweier Kurzgeschichten von Henrik Ibsen, sowie deren Interpretation durch Stanley Cavell und Theodor Adorno eine für den Einzelfall zu blinde, utilitaristische Gerechtigkeitsordnung. Anhand einer Diskussion der von John Rawls und Jürgen Habermas proklamierten Gesellschaftsmodelle entwickelt er schließlich eine eigene Gerechtigkeitstheorie, welche auf einem von ihm geforderten, fundamentalen Recht auf Rechtfertigung, sowie der Toleranz fremder Wert- und Moralvorstellungen aufbaut. Diese Konzeption, welche von der Anerkennungstheorie Axel Honneths abzugrenzen ist, formt eine kritische Theorie der Gerechtigkeit, welche sich stets ihrer Hinterfragung von Seiten der durch sie Betroffenen stellen muss und sich insofern stetig fortentwickelt.
