Voters must use all possible legal theories and arguments to ensure that Hillary Clinton, not Donald Trump, becomes our President. Clinton won the election by over two million popular votes and she is our rightful President.
It is the position of the author that the Electoral College does not have the authority to approve anyone other than the nationwide winner of the popular vote---Hillary Clinton----who won by over 2.5 million votes---as President. This is so because the Equal Protection Clause of the 14th Amendment to the U.S. Constitution guarantees that each voter's vote is required to be of equal value. This is known as "one person, one vote" or "one man, one vote." If Hillary is not installed as president, the votes of her voters (who voted for the various electors in their states) are not worth as much as the votes of those persons who voted for Donald Trump. The States Cannot Exercise Their Constitutionally Delegated Power to Select Electors for U.S. President in Ways that Violate Other Specific Provisions of the Constitution.
In Williams v. Rhodes, 393 U.S. 23, 29 (1968), the State of Ohio contended that Art. II, s. 1 gave it absolute power to "put any burdens it pleases on the selection of electors . . . ." The court, at 34, said the Ohio law violated the Equal Protection Clause (14th Amendment). It stated, at 29, that powers granted by the Constitution to Congress or the states are "always subject to the limitation that they may not be exercised in a way that violates other specific provisions of the Constitution." It specifically held that the power to select presidential electors could not "be expressed in such a way as to violate express constitutional commands that specifically bar States from passing certain kinds of laws."
