The Fourth Amendment of the United States Constitution was written to protect citizens from unjust searches and seizures of their personal property. This is a sticky concept, one that has resulted in many complicated court cases in recent years. Rich Smith outlines the basic principles of the Fourth Amendment and the debates surrounding it in a very clear and concise manner. Smith first describes the conditions under which people lived before the Revolutionary War, including how law enforcement officials could take anything they wanted from persons accused of crimes. Because the founding fathers did not want U.S. citizens to live under these conditions, they established rules that officials must follow when confiscating material during an investigation or arrest. This book includes conditions under which no warrant is needed, when rights must be limited for the greater good, stopping a suspect before the evidence disappears, and privacy at public schools. Smith uses many examples from real life to illustrate the delicate balance between privacy and public safety.
