The question the United States Supreme Court had to consider in The New York Times v. United States in 1971 was whether or not news providers should be allowed to publish stories that may prove detrimental to the United States during wartime. The Nixon administration sought to stop the The New York Times and The Washington Post from publishing the classified memos known as the Pentagon Papers. The Pentagon Papers revealed how President Johnson secretly paved the way to use combat forces in Asia. They also detailed how the President had avoided consulting Congress, the legislative body with sole power to declare war, before committing both ground and air forces to Vietnam. and diverting Federal funds toward the war effort. The Times decided to publish some of the 7,000 pages of the Pentagon Papers on the conviction that American citizens and their elected officials had the right to be informed of Johnson's "secret war." Herda brings to life the people and events during the time of the case while considering the political and cultural climate of the Vietnam War era.
