Overview

The setting is the United States of America, land of the free, yet the world’s leading jailer.

The U.S. prison population has reached an explosion point. Attorney and author Jack W. Cline reveals the issues involved in his powerful memoir Yardbird USA: How the United States Became the World’s Leading Jailer (Musings of a Trial Lawyer).

The book contains a dozen true crime cases with bizarre, humorous and unjust outcomes, but all point to a single conclusion: Politicians have made a mess of the criminal justice system, and have created a monster in the U.S. prison population.

As a result of the prison population explosion of the past two decades, Americans now have more people behind bars than Russia and China combined! The cost and side effects of this fetish for incarceration is staggering. How did this happen and what can be done to stop the bleeding?

About the Author

Jack W. Cline is a practicing trial lawyer in western Pennsylvania. “I am very disturbed at our prison population growth, the criminal justice system being hijacked by the legislative branch, and the erosion of our liberties. This book is a must read for everyone concerned about our nation's exploding prison population. Each chapter deals with a true case that will make you shake your head and wonder how our criminal justice system became such a mess. It is written with wit, humor and, yes, even a bit of sarcasm. I thoroughly enjoyed it.

The arguments made in Yardbird USA related to mandatory minimum sentencing and similar issues are quite compelling and not often discussed in popular discourse. We hear and read about the judiciary “legislating from the bench,” but not so much about legislators creating irrational restrictions on the judiciary. This book looks at a different issue related to separation of powers in America. Written by a defense attorney, Yardbird looks in depth at the plight of the accused, people often overlooked by society … those who fall through the cracks and whose lives are sometimes made impossibly difficult by mindless “minimum” sentences and exorbitant bail requirements , handed down by politicians wishing to pander to voters by appearing “tough.” Cline’s book examines the high cost of political hubris, not only in terms of off-the-charts prison occupation (making the United States the Worlds #1 Jailor); but also in the human cost to fairness; freedoms that should be guaranteed by the US constitution; and the harms of self-perpetuating societal issues created by “criminalizing” more and more US citizens. This book is instructive and surprisingly entertaining – at times laugh-out-loud funny! The case stories are quite engaging, with a no-nonsense tone, ironic sense of humor, and salty diction. The author creates a neat balance between the serious/informative and human interest/entertainment, with plenty of local color thrown into the mix. Yardbird USA definitely merits a read! I believe the persona of this writer, as the narrator, has the potential to become a popular novel, which many additional readers would enjoy.

Hard to believe that the USA is the world’s leading jailer until I read this book. Now I understand what mandatory minimum sentencing laws are, and how these inflexible “one-size-fits-all” laws have undermined our justice system. Yard bird USA shows how the United States Congress and mandatory sentencing laws have left our local judges with little discretion in judgement. As Jack Cline opines, the criminal justice system has been hijacked by the legislative branch of our government. I highly recommend this book as a call to action and can only hope that Mr. Cline will soon publish another proposing a solution.

Thanks for the kind words of review Tom. I take it that the 3 of 5 rating means that the book was 40% too short! Jack
