Barry's practice has included civil litigation in the state and federal courts, nonprofit law, and constitutional law with a particular focus on First and Second Amendment freedoms. Barry served as a member of the Colorado House of Representatives from 1997 to 1998 and co-founded Jefferson Academy, a successful charter school in Colorado. Two of Barry's cases have reached the United States Supreme Court.
