The point of origin for this work is the question: to which extent the "universal succession by virtue of the transaction” can be made useful for the business transation. The organizational possibilities made possible by the German Reorganization of Companies Act 1994 - and on a legally comparative level, the Swiss Merger Act 2003 and the Austrian Companies Code 2007 - prompted this examination.
