Gaetano Martino was an unemployed longshoreman whose first scrape with the law occurred in 1928. The incident, a jewelry theft, happened in Manhattan. The 1940 U.S. Census says that Martino was unemployed for twenty-four years. In 1928 his wife, Josephine, and three children lived with him in Brooklyn.
